1K5° Life Customer Terms & Conditions
1KOMMA5° Australia
Version: 5 October, 2026
These terms apply to you and your 1K5 Life Subscription.
Please read them and keep a copy.
If there is anything you do not understand, contact us before you subscribe.
1. About 1K5 Life and These Terms
1.1 1K5 Life is an annual subscription. It gives you a package of monitoring, support and advisory services for your 1K5 branded battery and inverter system, together with the benefit of Life Cover described in clause 8.
1.2 These terms form a binding agreement between you and 1K5 Heartbeat Pty Ltd (ACN 682 650 915) (ABN: 27 682 650 915) (we, us, our).
1.3 1K5 Life is a service and maintenance subscription. It is not insurance. It is not a financial product. It is not a promise to make good loss or damage to your property. We do not insure your system, your home or your energy costs.
1.4 Your agreement with us is made up of:
(a) these terms;
(b) the quote or order you accepted, which records the system your subscription applies to and the fee payable;
(c) the Inclusions Schedule set out in Schedule 2 ; and
(d) our privacy policy.
1.5 If there is any inconsistency between those documents, they apply in the order listed in clause 1.4 .
1.6 1K5 Life sits on top of 1K5 Care, which is included with every 1K5 branded system at no additional cost. 1K5 Life does not replace or reduce your rights under 1K5 Care, under the standard product warranty for your system, or under the Australian Consumer Law.
2. Meaning of Words
2.1 In these terms:
(a) Accredited Installer means an installer that is certified and approved by us to work on 1K5 branded products.
(b) Australian Consumer Law means the Australian Consumer Law contained in Schedule 2 to the Competition and Consumer Act 2010 (Cth).
(c) Cover Event has the meaning given in clause 8.2 .
(d) Cover Period means, for a Covered Product, the period stated in the third column of Schedule 1.
(e) Covered Products means the battery stack and inverter identified in your quote or order, being an Eligible Product installed at the Site.
(f) Customer, you and your mean the person named as the customer in your quote or order.
(g) Eligible Product means a product listed in Schedule 1 .
(h) Heartbeat AI means the Heartbeat AI energy optimisation service offered under the 1K5 brand.
(i) Inclusions Schedule means Schedule 2 , as updated by us from time to time in accordance with clause 14 .
(j) Life Cover means the entitlement described in clause 8 .
(k) Performance Threshold means the point at which the usable capacity of a battery falls below 60% of its nominal capacity, measured in accordance with the manufacturer warranty conditions for that product and subject to the temperature and energy throughput limits set out in those conditions.
(l) Site means the address at which the Covered Products are installed, as recorded in your quote or order.
(m) Standard Warranty Period means, for a Covered Product, the period stated in Schedule 1 running from the date the Covered Product is first installed and commissioned.
(n) Subscription Year means each 12 month period beginning on the Start Date and on each anniversary of it.
3. Who Can Subscribe
3.1 You may subscribe to 1K5 Life if, at the time you sign up:
(a) you have purchased an Eligible Product from us or from an authorised 1K5 partner;
(b) the Eligible Product is being, or will be, installed and commissioned at the Site by an Accredited Installer; and
(c) you have an active Heartbeat AI subscription.
3.2 Once the Eligible Product has been energised, it is no longer possible for you to subscribe to 1K5 Life.
3.3 A subscription applies to a single battery stack, at a single Site, held by a single Customer. If you have more than one battery stack, or more than one Site, a separate subscription is required for each.
3.4 1K5 Life is offered only in connection with a new purchase of an Eligible Product. It is not available for any system installed prior to the commencement of your subscription, and it is not available to a person who acquires a system that has already been installed.
3.5 We may decline an application for any reason. If we do, we will tell you and refund anything you have paid.
4. Starting Your Subscription, Term and Renewal
4.1 Your subscription starts on the later of the date your Heartbeat AI service is activated and the date your first fee is paid or a discount is applied to it (the Start Date).
4.2 Your subscription runs for one Subscription Year and renews automatically for further Subscription Years until it is cancelled or terminated.
4.3 At least 14 days before each renewal we will tell you the renewal date and the fee that will be charged.
4.4 Your subscription must run continuously. If it lapses, for any reason, it cannot be reinstated. Clause 13.5 explains what that means for Life Cover.
5. Cooling Off
5.1 You may cancel your subscription for any reason within 10 days after the Start Date. If you do, we will refund everything you have paid for that Subscription Year.
5.2 To cancel during the cooling off period, email or call us using the contact details in clause 17 .
5.3 If your agreement with us was an unsolicited consumer agreement for the purposes of the Australian Consumer Law, you may have a longer cooling off period. Nothing in these terms affects that right.
6. Fees and Payment
6.1 Your fee is set out in your quote or order. It is based on the usable capacity of your battery stack at the Start Date and it includes GST this quote or order is provided to you by email.
6.2 Your fee is fixed for as long as your subscription continues. We will not increase it.
6.3 We may reduce your fee, or discount it for a particular Subscription Year. A discount given for one Subscription Year does not change the fee payable in later Subscription Years.
6.4 The fee is payable annually in advance, on the Start Date and on each anniversary of the Start Date.
6.5 You must keep a valid payment method on file with us. If a payment fails, we will tell you and give you at least 14 days to correct it before we act under clause 13.3 .
6.6 Your subscription covers the Covered Products as configured at the Start Date. You cannot add to the Covered Products.
7. The Services We Provide
7.1 The Inclusions Schedule sets out the services included with 1K5 Care and with 1K5 Life, and the service levels that apply to them.
7.2 Some services are provided by us. Others are provided by our related companies, by Accredited Installers, or by other service providers we engage.
7.3 The Life Energy Adviser service consists of two consultations of up to 30 minutes in each Subscription Year. Unused consultations do not carry over.
7.4 We may add to or improve the services at any time. We will not materially reduce them except in accordance with clause 14 .
7.5 We are not required to provide a service where access to the Site is unsafe or is not made available. Where the Site is in a regional area we may appoint a suitably certified installer who is not local.
7.6 Where we provide advice, guidance or similar within the 1K5 Care or 1K5 Life services via email, you acknowledge and agree that these are not marketing emails and are not capable of being unsubscribed from whilst you have an active 1K5 Care or 1K5 Life subscription (as the case may be).
8. Life Cover
8.1 Life Cover is our promise to procure and deliver to you one replacement battery and one replacement inverter for the Covered Products, on the terms set out in this clause 8 .
8.2 A Cover Event occurs on the earlier of:
(a) the expiry of the Standard Warranty Period for the Covered Products; and
(b) the date on which we determine that a Covered Product has fallen below the Performance Threshold.
8.3 Where a Covered Product falls below the Performance Threshold during the Standard Warranty Period, your claim is dealt with under the standard product warranty for that product. Life Cover then applies to the Covered Products as repaired or replaced under that warranty.
8.4 Following a Cover Event we will contact you using the details we hold for you. You must tell us within three months after that notice whether you wish to claim. We will send you at least two reminders. If we have not heard from you within six months after the first notice, Life Cover ends and no replacement products will be supplied.
8.5 We will use reasonable endeavours to deliver the replacement products within 12 months after the Cover Event. Delivery timing depends on manufacturer supply and on matters that may be outside our control.
8.6 The replacement products will be of equivalent or better specification than the Covered Products. The original model may no longer be manufactured. We will select the replacement model, acting reasonably, and it may be a substitute product whose performance and capacity is substantially similar to or better than the Covered Products.
8.7 We supply the replacement battery and inverter at no additional cost to you.
8.8 You are responsible for the cost of everything else involved in the replacement, including delivery to the Site, removal and disposal of the existing system, installation, commissioning, any electrical, switchboard or metering work, and any network or grid approval that is required. We will give you a quote for that work, at our rates current at the time, before it is carried out.
8.9 The replacement products carry a warranty for the Cover Period stated in Schedule 1, running from the date they are commissioned. That warranty applies only if the replacement products are installed and commissioned by an Accredited Installer.
8.10 Life Cover may be claimed once. Once the replacement products have been delivered, Life Cover is satisfied and does not apply again.
8.11 Life Cover is conditional on all of the following:
(a) your subscription having run continuously and all fees having been paid when due;
(b) the Covered Products having been registered by us with the manufacturer within the manufacturer registration period;
(c) the Covered Products remaining installed at the Site;
(d) you having met your obligations under clause 9 ; and
(e) none of the circumstances in clause 10 applying.
9. What We Need From You
9.1 You must keep your subscription current and pay each fee when it falls due.
9.2 You must keep your system connected to the internet so that, where monitoring services apply to you, we can receive performance data from it.
9.3 You must give us accurate information, including your name, the Site address, the National Metering Identifier for the Site and the serial numbers of the Covered Products, and tell us if any of that information changes. You authorise us to register the Covered Products with the manufacturer.
9.4 You must have the Covered Products serviced, repaired, altered and worked on only by an Accredited Installer.
9.5 You must not modify, alter, add to, remove or relocate the Covered Products without our prior written consent.
9.6 You must operate the system in accordance with the manuals supplied with it, including the ambient temperature and energy throughput limits set out in those manuals.
9.7 You must tell us promptly if you become aware of a fault, and give us and our Accredited Installers safe access to the Site to investigate and carry out work.
9.8 If a Covered Product is replaced, you must allow us to remove and retain the product that has been replaced.
9.9 You must tell us within 30 days if you sell the Site, or otherwise stop owning or occupying it.
9.10 If you do not meet these obligations we may refuse a claim under Life Cover, or terminate your subscription under clause 13.3 .
10. What Is Not Covered
10.1 Life Cover and the services do not extend to a fault, defect or loss of performance caused by or arising from:
(a) improper installation or commissioning, or installation by a person who is not an Accredited Installer;
(b) operation of the system contrary to the manuals supplied with it;
(c) insufficient ventilation or air circulation as a result of installation contrary to the commissioning requirements;
(d) unauthorised repair, reinstallation or modification;
(e) the use of parts, plugs or components that were not supplied with the Covered Products or approved by us;
(f) damage originating in other parts of your system, or in equipment we did not supply;
(g) storm, lightning, over-voltage, fire, flood, theft, vandalism, pest damage, or any other event outside our reasonable control;
(h) damage occurring in transport;
(i) cosmetic damage, or wear and tear that does not affect the proper functioning of the product;
(j) operation outside the temperature or energy throughput limits set out in the manuals;
or
(k) any Covered Product that has been resold, moved or relocated.
10.2 The services do not include electrical work at the Site, work on equipment we did not supply, or any work that is not covered by a warranty.
10.3 If we or an Accredited Installer attend the Site and find no fault, or find a fault that is not covered, we may charge you for the attendance and any testing at our rates current at the time. We will tell you what that is likely to cost before we attend.
11. Heartbeat AI
11.1 You must have an active Heartbeat AI subscription at the time you sign up for 1K5 Life.
11.2 Heartbeat AI is a separate service, provided under a separate agreement and billed separately. These terms do not apply to it.
11.3 If your Heartbeat AI subscription ends, your 1K5 Life subscription continues and:
(a) you keep Life Cover, the Life Energy Adviser service and the 1K5 Life newsletter;
(b) you stop receiving Life Monitor and the Life Assessment, because we no longer have visibility of how your system is performing; and
(c) your fee does not change.
11.4 If you take up Heartbeat AI again, the services suspended under clause 11.3(b) resume.
11.5 While you are not a Heartbeat AI customer we will not be able to identify a Cover Event under clause 8.2(b) . You should contact us if you believe the performance of your system has declined.
12. Your Subscription is Personal To You and To Your Site
12.1 Your subscription is personal to you. You cannot transfer, assign, sell, gift or otherwise deal with it, and any attempt to do so has no effect.
12.2 Your subscription covers one battery stack at the Site recorded in your quote or order. It does not follow the system if the system is moved, and it does not follow you if you move.
12.3 If you sell the Site, or otherwise stop owning or occupying it:
(a) you must tell us in accordance with clause 9.9 ;
(b) your subscription terminates on the later of the date you tell us and the date we become aware of it;
(c) fees already paid are not refunded; and
(d) your subscription does not pass to the new owner or occupier.
12.4 If you own the Site and continue to own it, your subscription continues even if the Site is tenanted, provided you remain the Customer and continue to pay the fee.
12.5 A new owner or occupier of the Site cannot take over your subscription, and we do not offer an equivalent arrangement to a new owner or occupier in respect of a system that has already been installed.
12.6 If the Covered Products are moved to another address, Life Cover ends.
12.7 If you die, your subscription terminates at the end of the Subscription Year in which we are notified, unless your legal personal representative, or a person who acquires the Site, notifies us within three months and we agree in writing to continue it.
12.8 We may assign or novate our rights and obligations to a related body corporate, or to a person who acquires our business, on notice to you.
13. Cancelling and Ending Your Subscription
13.1 You may cancel your subscription at any time. Cancellation takes effect at the end of your current Subscription Year, and you continue to receive the services until then. Fees already paid are not refunded, in whole or in part.
13.2 Clause 13.1 does not affect your cooling off rights under clause 5 .
13.3 We may suspend or terminate your subscription if:
(a) a fee is not paid and remains unpaid 14 days after we have told you;
(b) you breach these terms in a material way and do not fix the breach within 14 days after we have told you;
(c) you stop meeting the eligibility requirements in clause 3 ;
(d) the Covered Products are removed, relocated or replaced other than under clause 8 ;
or
(e) you have given us information that is materially false or misleading.
13.4 We may terminate your subscription by giving you at least 90 days notice if we stop offering 1K5 Life. If we do, we will refund the part of your fee that relates to the unexpired portion of the current Subscription Year.
13.5 If your subscription ends for any reason other than under clause 13.4 :
(a) Life Cover ends immediately and permanently;
(b) you cannot rejoin, and we cannot reinstate your subscription, because the arrangements that support Life Cover are lost once a subscription lapses; and
(c) fees already paid are not refunded.
13.6 We will tell you in writing before Life Cover is lost as a result of non-payment.
14. Changes to These Terms and to the Services
14.1 We may change these terms and the Inclusions Schedule from time to time, including to reflect changes in the law, in our systems, or in the services available to you.
14.2 We will give you at least 30 days notice of a change before it takes effect.
14.3 If a change is likely to disadvantage you in a material way, you may cancel your subscription before the change takes effect, and we will refund the part of your fee that relates to the unexpired portion of the current Subscription Year.
15. Australian Consumer Law and Liability
15.1 Our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law. Nothing in these terms excludes, restricts or modifies those guarantees, or any other right you have that cannot be excluded.
15.2 The following statements are required by law:
Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.
Our services come with guarantees that cannot be excluded under the Australian Consumer Law. For major failures with the service, you are entitled to cancel your service contract with us and to a refund for the unused portion, or to compensation for its reduced value. You are also entitled to be compensated for any other reasonably foreseeable loss or damage. If the failure does not amount to a major failure, you are entitled to have the failure rectified in a reasonable time. If this is not done you are entitled to a refund for the services.
15.3 To claim the benefit of Life Cover, contact us using the details in clause 18.1 . You bear the expense of claiming, including the costs described in clause 8.8 .
15.4 Where we are permitted by law to limit our liability, our liability is limited, at our option, to resupplying the services or paying the cost of having them resupplied, or to replacing the goods or paying the cost of replacing them.
15.5 We are not liable for consequential loss, loss of profit, loss of savings, loss of feed-in tariff revenue, or loss of use, except to the extent the Australian Consumer Law provides otherwise.
15.6 If you are not a consumer for the purposes of the Australian Consumer Law, our total liability in connection with your subscription in any 12 month period is limited to the fees you paid us for 1K5 Life in that period.
15.7 Neither of us is liable for a failure to perform caused by an event outside our reasonable control, for so long as that event continues.
16. Privacy and Your Data
16.1 To provide the services we collect and use information about you and about your system, including performance data generated by your system and, while you are a Heartbeat AI customer, information from your energy retailer.
16.2 We use that information to monitor the performance of your system, to raise and resolve support tickets, to prepare your Life Assessment, to register the Covered Products with the manufacturer, and to administer your subscription.
16.3 We may disclose that information to our related companies, our service providers, Accredited Installers and the manufacturer of your system. Some of those recipients are located outside Australia. Our privacy policy at https://1komma5.com/au/legal/privacy-policy-au/ explains how we handle personal information and how you can access it, correct it or make a complaint.
17. Intellectual Property and Data
17.1 We own, or are licensed to use, all intellectual property rights in the 1K5 Life services and in everything we produce or provide in connection with them, including the Life Assessment, the output of the Life Welcome Check, any report, recommendation or advice provided by the Life Energy Adviser, our monitoring and diagnostic tools and methods, and our documentation and marketing material (our Materials). Nothing in these terms transfers any of those rights to you.
17.2 We grant you a personal, non-exclusive, non-transferable and royalty free licence to use our Materials for the purpose of operating your system and obtaining the benefit of the services, for as long as your subscription continues. You must not sell, publish, sublicense or commercially exploit our Materials, or use them for the benefit of another person, without our prior written consent.
17.3 Your system, and the services connected to it, generate operational and performance data, including generation, consumption, charge and discharge, state of health, fault and connectivity data, together with information about your energy plan and usage while you are a Heartbeat AI customer (System Data).
17.4 As between you and us, you own the System Data that relates to your system. Nothing in this clause 17 changes that.
17.5 You grant us a non-exclusive, royalty free and worldwide licence to use, copy, store, analyse and adapt the System Data, and to permit our related companies, our service providers and the manufacturer of your system to do the same, for the purposes of:
(a) providing the services to you, including monitoring, diagnosis, support and the preparation of your Life Assessment;
(b) administering your subscription and any claim under Life Cover;
(c) meeting our obligations to the manufacturer of your system, including product registration and warranty administration;
(d) improving the products and services we offer and developing new ones; and
(e) producing aggregated or de-identified statistics, benchmarks, insights and analytics.
17.6 The licence in clauses 17.5(a) to 17.5(c) ends when your subscription ends. The licence in clauses 17.5(d) and 17.5(e) continues after your subscription ends, but only in respect of System Data generated while your subscription was on foot.
17.7 Where we use System Data under clause 17.5(d) or 17.5(e) we will first aggregate or de-identify it so that neither you nor the Site can reasonably be identified, unless we need identified data in order to provide the services to you or to meet our obligations to the manufacturer of your system.
17.8 We own all intellectual property rights in any statistic, benchmark, model, insight, report or other output that we create from System Data in aggregated or de-identified form. We may use and commercialise those outputs without restriction and without any obligation to account to you, provided they do not identify you or the Site.
17.9 Clause 17 continues to apply to any System Data that is personal information about you.
17.10 The Covered Products, and any replacement products supplied under clause 8 , contain embedded software and firmware. That software is licensed to you, not sold. You have a non-exclusive and non-transferable licence to use it as embedded in the product, at the Site, for as long as you own the product. You must not copy, modify, reverse engineer, decompile, disassemble or attempt to derive the source code of that software, and you must not remove or alter any proprietary notice, except to the extent you are entitled to do so under a law that applies despite this clause.
17.11 Interfering with the embedded software is a modification for the purposes of clause 9.5 , and may result in the loss of both the manufacturer warranty and Life Cover under clause 10.1(d) .
17.12 We, or the manufacturer of your system, may issue software or firmware updates. You must not prevent or defer an update that we tell you is required for safety, for compliance with the requirements of your electricity distributor, or for the continued operation of the services.
17.13 If you give us feedback, suggestions or ideas about the products or the services, we may use them without restriction and without any obligation to you. You are not obliged to give us feedback.
17.14 1KOMMA5°, 1K5, 1K5 Life, 1K5 Care and Heartbeat AI, and the associated logos, are trade marks used by us or by our related companies. You must not use them without our prior written consent.
17.15 If you give us photographs, documents or other material to help us provide the services, you keep ownership of that material. You grant us a licence to use it for the purpose of providing the services and dealing with any claim you make.
17.16 Clauses 17.1 , 17.5(d) , 17.5(e) , 17.6 , 17.8 , 17.10 , 17.13 and 17.14 continue to apply after your subscription ends.
